These Terms and Conditions govern the use of the website dev.remotesensors.it (the "Website") and the supply of products offered through it. Please read them before using the Website, requesting a quotation or placing an order. By using the Website you accept these Terms.

2. Scope

We supply inspection equipment and accessories (thermal cameras, NDT equipment, acoustic imaging cameras, gas detection instruments, lenses, batteries) from qualified manufacturers. Our products are intended mainly for professional users.

These Terms apply to all use of the Website and, unless otherwise agreed in writing, to every quotation and order. If a quotation, order confirmation or separate contract contains different conditions, those specific conditions prevail for that transaction. Any general terms of purchase of the customer apply only if we accept them in writing.

3. Product information

We describe products on the Website based on information provided by the manufacturers. Technical specifications, images and documents are for general information. They may change without notice and do not constitute a guarantee of performance in a specific application. Actual performance depends on the model, configuration, accessories, operating conditions and the qualification of the operator.

Before purchasing, please confirm with us that the product is suitable for your application. The binding technical data are those stated in the quotation or order confirmation and in the manufacturer's documentation supplied with the product.

4. Quotations and orders

Information on the Website is not a binding offer. A request for a quotation submitted through the Website does not create any obligation for either party.

Our quotations are valid for the period stated in them (30 days if no period is stated). A contract is formed only when we send a written order confirmation, or when we deliver the products. We may decline an order, for example if the product is no longer available or if the requirements described in section 9 are not met.

5. Prices and payment

Prices are those stated in the quotation or order confirmation. Unless otherwise stated, prices are in euro (EUR), exclusive of VAT, duties, transport, insurance and installation. Amounts shown in other currencies on the Website are indicative conversions; invoicing is in EUR unless agreed otherwise.

Payment terms are stated in the quotation. In case of late payment by business customers, interest applies under Legislative Decree 231/2002. We may suspend deliveries while payments are overdue.

6. Delivery and transfer of risk

Delivery terms (Incoterms® 2020 rule, place and estimated time) are stated in the quotation or order confirmation. Delivery times are estimates and depend on manufacturer availability. We will inform you of any significant delay.

Risk passes to the customer in accordance with the agreed Incoterms® rule. Ownership passes when the price has been paid in full.

7. Inspection on receipt and claims

Please check the products on receipt. Visible damage to packaging should be noted on the carrier's delivery document. For business customers, defects must be reported in writing within 8 days of discovery, in accordance with Article 1495 of the Italian Civil Code. Products may be returned only with our prior written authorisation.

8. Warranty

Products are covered by the warranty stated in the quotation, which generally corresponds to the manufacturer's warranty for that product. Warranty periods and conditions differ between manufacturers and product lines and cannot be considered uniform.

The warranty does not cover damage caused by improper use, use outside the manufacturer's specifications, unauthorised repair or modification, accidents, or normal wear of consumable parts such as batteries. Warranty service is carried out by us or through the manufacturer's authorised service network.

9. Proper use, safety and export control

The products are measuring and inspection instruments. They must be used by trained personnel in accordance with the manufacturer's manuals. Measurement results depend on the procedure, the instrument settings and the conditions at the site. Decisions based on these results remain the responsibility of the user.

Only products with the corresponding certification may be used in potentially explosive atmospheres (ATEX or equivalent). Please check the certification of the specific model before use.

Some products, such as certain thermal imaging cameras, may be subject to export control rules, including Regulation (EU) 2021/821 on dual-use items, and to EU or international sanctions. The customer agrees to comply with these rules, to provide end-use and end-user information on request, and not to re-export products in violation of them. We may suspend or cancel an order if we cannot confirm compliance.

10. Consumers

If you purchase as a consumer (a natural person acting outside a business or profession), you have the rights granted by the Italian Consumer Code (Legislative Decree 206/2005), including the legal guarantee of conformity and, for distance contracts, the right of withdrawal within 14 days. Nothing in these Terms limits those rights. Where these Terms conflict with mandatory consumer law, the law prevails.

11. User accounts

Some functions of the Website require an account. You are responsible for keeping your login details confidential and for the accuracy of the information you provide. We may suspend accounts used in breach of these Terms or of the law.

12. Intellectual property

The content of the Website (texts, layout, graphics, logos) belongs to us or is used under licence. It may not be copied or reused without our written permission, except for personal, non-commercial consultation.

Product names, trademarks and images of manufacturers, including Guide, Raythink, Evident, Crysound and PERGAM, belong to their respective owners and are used only to identify the products we supply.

13. Limitation of liability

We take care to keep the Website accurate and available, but we do not guarantee that it is free of errors or interruptions. To the extent permitted by law, we are not liable for indirect or consequential losses, such as loss of production, profit or data, arising from the use of the Website or the products. For business customers, our total liability for a given order is limited to the price of that order.

These limitations do not apply in cases of wilful misconduct or gross negligence (Article 1229 of the Italian Civil Code), personal injury, or where liability cannot be excluded by law, including product liability under the Consumer Code.

14. Third-party links

The Website may contain links to manufacturers' or other third-party websites. We are not responsible for their content or their privacy practices.

15. Personal data

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR). Details are provided in our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. The version published on the Website on the date of your quotation request or order applies to that transaction.

17. Governing law and jurisdiction

These Terms and all contracts to which they apply are governed by Italian law. The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna 1980) does not apply.

For business customers, the Court of Brescia has exclusive jurisdiction. For consumers, the competent court is that of the consumer's place of residence or domicile in Italy. Consumers may also use the out-of-court dispute resolution procedures provided by law.

18. Language

These Terms are available in Italian and English. In case of discrepancy, the Italian version prevails.
